1. Agreement to Terms
By accessing or using LearnGolf.com ("the Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not access or use the Platform.
These Terms apply to all users of the Platform, including students seeking golf instruction, instructors offering lessons, and visitors browsing the site.
2. Description of Service
LearnGolf is an online marketplace that connects golf students with certified golf instructors. The Platform enables students to discover instructors, book lessons, and manage their golf education.
LearnGolf acts solely as a marketplace and intermediary. We are not a golf instruction provider, and instructors on the Platform are independent professionals, not employees or agents of LearnGolf.
The Platform charges a service fee of 15% on each completed booking. This fee is deducted from the lesson price before the instructor receives payment.
3. User Accounts
To use certain features of the Platform, you must create an account. You agree to:
- •Provide accurate, current, and complete information during registration
- •Maintain and promptly update your account information
- •Maintain the security of your password and accept responsibility for all activities under your account
- •Notify us immediately of any unauthorized use of your account
You must be at least 18 years of age to create an account. If you are under 18, you may use the Platform only with the involvement of a parent or guardian.
4. Booking & Payments
When you book a lesson through the Platform, you agree to pay the listed price plus any applicable fees. All prices are displayed in US Dollars.
- •Pricing: Lesson prices are set by individual instructors and displayed on their profiles. The total booking price includes the instructor's fee.
- •Payment Processing: Payments are processed securely through our third-party payment processor, Stripe. By making a payment, you agree to Stripe's terms of service.
- •Cancellations: Bookings may be cancelled up to 24 hours before the scheduled lesson for a full refund. Cancellations within 24 hours may be subject to a cancellation fee at the instructor's discretion.
- •Refunds: Refund requests are handled on a case-by-case basis. If a lesson does not occur due to instructor cancellation, you will receive a full refund.
- •Referral Program: Users may earn store credit by referring new users to the Platform. Referral credits are subject to the Referral Program Terms.
5. Instructor Obligations
Instructors who list their services on the Platform agree to:
- •Provide accurate information regarding their qualifications, certifications, and experience
- •Maintain any professional certifications displayed on their profile (PGA, LPGA, etc.)
- •Honor confirmed bookings and arrive prepared for scheduled lessons
- •Maintain appropriate liability insurance for golf instruction
- •Comply with all applicable local, state, and federal laws
6. Student Responsibilities
Students using the Platform agree to:
- •Arrive on time for scheduled lessons
- •Provide accurate information when booking lessons, including skill level and any physical limitations
- •Treat instructors with respect and professionalism
- •Cancel bookings in a timely manner if unable to attend
- •Assume the inherent risks associated with participating in golf activities
7. Prohibited Conduct
You agree not to:
- •Use the Platform for any unlawful purpose
- •Impersonate any person or entity, or falsely represent your affiliation
- •Interfere with or disrupt the Platform or its servers
- •Attempt to circumvent the Platform to avoid paying service fees
- •Harass, threaten, or intimidate other users
- •Post false reviews or manipulate the rating system
- •Scrape, data-mine, or use automated means to access the Platform without prior written consent
8. Intellectual Property
The Platform and its original content, features, and functionality are owned by LearnGolf and are protected by international copyright, trademark, and other intellectual property laws.
You may not reproduce, distribute, modify, create derivative works of, publicly display, or in any way exploit the Platform or its content without prior written permission from LearnGolf.
9. Limitation of Liability
LearnGolf is a marketplace platform and does not provide golf instruction directly. We do not guarantee the quality, safety, or legality of lessons offered by instructors, nor the accuracy of instructor profiles.
To the fullest extent permitted by law, LearnGolf shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or other intangible losses, resulting from:
- •Your use or inability to use the Platform
- •Any conduct or content of any third party on the Platform
- •Any injuries sustained during golf lessons booked through the Platform
- •Unauthorized access to or alteration of your data
10. Dispute Resolution
Any disputes between students and instructors should first be addressed between the parties directly. If a resolution cannot be reached, LearnGolf may assist in mediating the dispute at our discretion.
Any disputes arising from these Terms or your use of the Platform shall be resolved through binding arbitration in accordance with the rules of the American Arbitration Association. You agree to waive any right to a jury trial or to participate in a class action.
11. Modifications to Terms
We reserve the right to modify these Terms at any time. We will notify registered users of material changes via email. Your continued use of the Platform after changes are posted constitutes acceptance of the updated Terms.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions.
